Liability Waiver

In exchange for the privilege to rent this golf cart, you are accepting responsibility for your own negligence. You must operate this vehicle in a safe manner, and adhere to all rules set forth by The Curvy Palm. You are liable for all medical and legal claims that may arise from rental of the golf cart. You voluntarily agree to accept the risk of using a golf cart and on behalf of yourself, your personal representatives and your heirs hereby voluntarily release the aforementioned business, and its owners, officers, employees, and agents from any and all claims, actions, causes of actions, suits, judgements and demands for bodily injury, property damage, loss of life and/or loss of services, in law or equity, that may in any way or manner arise out of use of the golf cart.

You must be at least 18 years of age and show a valid drivers license to rent a golf cart. Cart must remain on roads under 20mph and within the neighborhood boundaries as outlined below. Do not take cart on nature trails, native grass areas, etc... Maximum of 4 people on cart and all passengers must be seated with seatbelts. NO CHILDREN ALLOWED IN DRIVERS LAP. Anyone observed abusing golf cart rules and regulations will forfeit all rental privileges immediately and will forfeit the security deposit. This includes reckless driving, careless driving, or allowing underage guest to operate the cart. Any driver must be over 16 years old and posses a valid drivers license. At no time may a minor have a hand or hands on the steering wheel when the vehicle is moving. This requires you to have possession/control of vehicle keys when not in use.

You agree to pay for any damage (including lost keys) to the cart and will reimburse The Curvy Palm for any damages beyond the paid security deposit. You further agree to pay for any costs we incur to collect for damages. Blown curbed tires will result in a $200 fee with an exception of nails/screws in tires. Golf carts are a motorized vehicle and driving or riding in these vehicles can lead to serious injury, property damage and even death. No excessive speed, joy riding, or any type of unreasonable activity with the golf cart will be tolerated. You must not attempt to transport more people than the cart was designed for. If the management determines in its sole discretion that you have misused the golf cart in any way, it will require an immediate surrender of the keys with no refund and forfeiture of security deposit.

Renter must submit copy of valid drivers license, and the name must match name on the rental reservation. Upload required upon signing of this agreement.

By signing this agreement, you hereby declare you will follow and obey the following rules:

The golf cart can only be operated on city streets between sun up and sundown.
Golf cart may not be operated on Panama City Beach Pkwy or Front Beach Road, per county regulations.
Golf cart must be parked under carport at house when not in use.
DO NOT drive golf cart on front or back lawn of The Curvy Palm.
Golf cart will be only be charged when main switch under seat is in the "Off" position.
Rental period begins on day of reservation, at stated check-in time, and ends on day of check-out.
At no time will any passenger stand when vehicle is in motion, including sides or back of golf cart.
Golf cart is confined to neighborhood streets, bordered by Panama City Beach Pkwy to the north, Front Beach Road to the south, Southfields Rd to the west and Le Grand Dr to the east, as outlined by the highlighted area below:

If any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. Lessee acknowledges receipt of equipment below which is found by Lessee to be in working condition with noted exceptions. I have carefully read, understand and voluntarily agree to the terms above. I take full responsibility for myself, and anyone else I allow to operate this cart. I understand that my card will be authorized at the commencement of my rental for a damage deposit of the repair cost of the golf cart rented. I am responsible for the return of this equipment in the same state in which I received it. I agree to pay in full for any repairs or replacement if the equipment is damaged. I have fully informed myself of the contents of this agreement by reading it before I signed.
